User Agreement (September, 2005)________________________________________________________

 Use of this Web Board constitutes your acceptance and agreement to all of the following terms and conditions:

 General

 This web site and internet bulletin board (the "Web Board") is a complimentary service offered and hosted by the Denver District Attorney's Office ("DDA"), with the express condition that its users agree to be bound by the terms and conditions set forth in this User Agreement and the laws of the State of Colorado .

 The DDA reserves the right to change these terms and conditions at any time. To view the current version of this User Agreement (and not an older cached version) you should click on the "User Agreement" link at the bottom of the Web Board homepage.

 You understand and agree that the DDA reserves the right to terminate a user's access at any time and for any reason.

 You agree, as a user of this Web Board, that you waive any claim of privacy by your accessing the Web Board, and you further agree that you have no expectation of privacy in your use of the Web Board. You agree your use of the Web Board, and the administration and monitoring of the Web Board by DDA personnel are controlled by the laws of the State of Colorado .

 While it is the intent of the DDA and users of this Web Board that it to be a confidential "place" on the Internet, your use of the Web Board is nevertheless with your understanding and agreement that materials on the Web Board potentially may be subject to disclosure to the public under applicable public records or Freedom of Information laws or by court order.

 A signed and dated copy of this User Agreement must be provided to the DDA prior to a user obtaining access to the Web Board.

 Disclaimer Statement

 The Web Board website is for informational purposes only and is intended to be used only by currently authorized users in approved support agencies or organizations. Access or use by any other individuals is not permitted.

Use of the Web Board constitutes an agreement by the users to hold harmless the Denver District Attorney's Office or any of its employees in connection with their administration of the Web Board or information posted to the Web Board by other persons.

You acknowledge that the information on the Web Board is provided "as is" and for general information purposes only. You are responsible for making your own independent professional determination of all matters that are provided on the Web Board, consistent with your knowledge, experience, local practice or custom, and agency or organization policy.

This site may include chat and discussion boards. When you chat or join discussions, you agree to abide by all these Terms and Conditions. Our Web Board Community must be a confidential, safe, comfortable, and friendly environment. The DDA can remove any messages or solicitations that do not meet the standards of these Terms and Conditions. The DDA also reserves the right to immediately terminate a user's registration if they become aware of a user who violating any of these Terms and Conditions or any of the chat and discussion board guidelines as enumerated therein or if the user is otherwise engaging in behavior deemed inappropriate or unprofessional.

Commercial solicitation, chain letters, junk mail, "spam", non-commercial or bulk solicitation is prohibited.

Threatening harassing, libelous, defamatory, vulgar, profane, obscene, abusive, harmful, sexually oriented, racially offensive, inaccurate, or otherwise objectionable material of any kind or nature, is also prohibited.

The posting of unlawful material is just that: unlawful.

You are responsible for the appropriate use of copyrighted materials on the Web Board.

User Names and Passwords

You may not reveal your account user name(s) or password(s) to anyone else, nor may you use a user name or password belonging to someone else.

Limitation of Liability

You agree that you will hold harmless DDA employees and personnel from all claims arising out of or related to your access or use of, or your inability to access or use, this Web Board or the information contained in this Web Board or other websites to which it is linked. This includes, but is not limited to, information or materials viewed or downloaded from this Web Board or another website to which it is linked that appear to you or are construed by you to be obscene, offensive, defamatory, or that infringe upon your intellectual property rights or the intellectual property rights of another. In no event will the DDA, its employees or personnel, or the contributors of information to this Web Board be liable to you or anyone else for any decision made or action taken by you in reliance on such information or for any consequences caused thereby.

Endorsements

You acknowledge that the opinions, recommendations, and statements contained in this Web Board are expressed by individual authors and they are not necessarily those of the DDA or endorsed by the DDA or the agency or organization for which the individual author works.

The DDA or postings to the Web Board may provide links to other websites which are not under the control of the DDA. In general, any website which has an address (or URL) which does not contain "denverda.org" is such a website. These links are provided for convenience of reference only and are not intended as an endorsement by the DDA of the organization or individual operating the website or a warranty of any type regarding the website or the information on the website.

Privacy

The DDA reserves the right, at any time monitor, observe, record, or otherwise preserve all uses, communications, or other matters that occur on or through the Web Board. By using the Web Board, you understand and agree that you have no expectation of privacy with regard to anything you do on or through the Web Board and you hereby expressly consent to such monitoring, observation, recording, or preservation.

By executing this User Agreement you agree that your use of the Web Board, all postings you make, and your conduct in connection herewith are controlled by the laws of the State of Colorado . You also consent to the jurisdiction of the courts of the State of Colorado over you in connection with your use of the Web Board.

To help make the Web Board more responsive to the needs of its users or for better control and security, the DDA may at some time invoke a standard feature found in browser software, called a "cookie", to assign each user a unique, random number, a sort of anonymous user ID that resides on your computer. The cookie doesn't necessarily identify the user, just the computer that a user uses to access the Web Board. It is also possible that at some point in the future some other software or hardware technology may be used for these or similar purposes.

For internal purposes, the DDA may gather date, time, browser type, navigation history and IP address of all users of the Web Board. This information does not necessarily contain anything that can personally identify users. This information may be gathered for DDA internal security audit log, trend analysis, and system administration. ________________________________________________________

 I have read and agree to be bound in my use of the Denver District Attorney's Special Projects Web Board/Internet Bulletin Board by the terms and conditions of the above User Agreement and hereafter as the User Agreement may be periodically revised on the Web Board.
